TERMS OF SERVICE Last Updated: 21 January 2025 1) ACCEPTANCE OF TERMS By creating an account, accessing, or using Brogchat (the "Service"), you agree to be bound by these Terms of Service ("Terms"). These Terms are a legally binding agreement between you ("the User") and the operator of the Service ("the Provider"). If you do not agree to these Terms, do not use the Service. 2) ELIGIBILITY & ACCOUNT SECURITY • Age requirement: You must be 18 years of age or older to use the Service. The Provider does not knowingly permit minors. • Account responsibility: You are responsible for safeguarding your credentials and all activity on your account. • Account sharing is prohibited; the Provider may suspend or terminate shared or compromised accounts. 3) USER-GENERATED CONTENT (UGC) What you can post: • Audio, video, images, profile/background media, and other user-generated content. License granted to the Provider: • By submitting content you grant the Provider a non-exclusive, worldwide, royalty-free license to host, store, display, and process the content for operating the Service. Prohibited content (do not upload or share): • Illegal, defamatory, threatening, or violent content • Child Sexual Abuse Material (CSAM) — zero tolerance; such content will be removed and reported to the relevant authorities • Content that infringes intellectual property, privacy, or publicity rights of others • Content containing intense flashing or strobe effects likely to cause distress 4) LIVE VIDEO CHAT CONDUCT You must: • Obtain any legally required consent before recording, streaming, rebroadcasting, or redistributing another user's likeness or communications • Not impersonate others or present pre-recorded, automated, or simulated video as a live camera feed Note: The Service connects users randomly and may expose you to offensive or explicit behaviour. You interact at your own risk. 5) CONTENT MODERATION & REPORTING The Provider may (but is not required to): • Review, restrict, remove, or disable access to content or accounts • Suspend or terminate users for violations • Investigate reported misconduct Users may report violations using available reporting tools. The Provider may cooperate with law enforcement when required. The Provider is not obligated to proactively monitor content and does not guarantee the removal of all prohibited material. 6) ASSUMPTION OF RISK • Using live video chat with strangers carries risks including exposure to nudity, harassment, or offensive speech. You accept those risks; the Provider is not responsible for other users' conduct. 7) PREMIUM SUBSCRIPTIONS & FEES • Payments are handled by third-party payment providers; the Provider does not store payment card details • Purchases are final and non-refundable except where required by law • Provider may modify or discontinue premium features at any time 8) DISCLAIMER OF WARRANTIES • THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". THE PROVIDER DISCLAIMS ALL WARRANTIES TO THE MAXIMUM EXTENT PERMITTED BY LAW. 9) LIMITATION OF LIABILITY • TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PROVIDER IS NOT LIABLE FOR INDIRECT OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF DATA OR EMOTIONAL DISTRESS). • THE PROVIDER'S TOTAL LIABILITY SHALL NOT EXCEED AMOUNTS PAID BY THE USER IN THE SIX (6) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. 10) INDEMNIFICATION You agree to indemnify the Provider for claims arising from: • Your use of the Service • Your violation of these Terms • Your violation of third-party rights 11) TERMINATION • The Provider may suspend or terminate access at any time, with or without notice, for reasons including violations of these Terms. 12) PRIVACY • Use of the Service is governed by the Privacy Policy, which forms part of these Terms. 13) FORCE MAJEURE • The Provider is not liable for failures or delays caused by events beyond reasonable control (e.g., outages, cyber-attacks, infrastructure failures). 14) SEVERABILITY • If any provision is found unenforceable, the remaining provisions remain in force. 15) GOVERNING LAW & JURISDICTION • These Terms are governed by the laws of England and Wales. Disputes are subject to the exclusive jurisdiction of the courts of England and Wales. 16) DATA RETENTION • The Provider retains user data and logs as necessary to operate the Service, enforce Terms, prevent abuse, and comply with legal obligations. • Account deletion: Publicly visible content is removed immediately upon account deletion. • Log retention: Technical logs and records may be retained for up to thirty (30) days after deletion. • Permanent bans: Relevant logs/identifiers may be retained longer to prevent repeat abuse. The Provider does not retain personal data longer than reasonably necessary. 17) COPYRIGHT & DMCA POLICY The Provider respects the intellectual property rights of others and expects users to do the same. Copyright infringement: • Users must not upload, stream, or share content that infringes copyrights or other intellectual property rights. • The Provider does not permit repeated copyright infringement and will terminate repeat infringers where appropriate. If you believe content on the Service infringes your copyright, you may submit a written DMCA notice including: • Identification of the copyrighted work claimed to be infringed • Identification of the allegedly infringing material and its location on the Service • Your name, address, email address, and telephone number • A statement that you have a good-faith belief the use is not authorised by the copyright owner, its agent, or the law • A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorised to act on their behalf • Your physical or electronic signature Upon receipt of a valid notice: • The Provider will remove or disable access to the allegedly infringing content • The affected user may be notified of the removal Repeat infringers: • The Provider reserves the right to terminate accounts of users who are subject to repeated valid copyright complaints. The Provider will comply with the Digital Millennium Copyright Act (17 U.S.C. §512) where applicable. 18) ENTIRE AGREEMENT • These Terms constitute the entire agreement between you and the Provider regarding the Service and supersede prior agreements. 19) ASSIGNMENT • The Provider may assign or transfer these Terms in connection with a merger, acquisition, restructuring, or sale of assets.
